By bidding for any items included in the sale the bidder confirms that he accepts and is bound by the following terms :

2. Bids must be written and made in Euros.
   
3. A ‘Buyer’s Premium’ of 13.5% and VAT (where applicable) will be added to the amount of the bid.
   
4. The seller is the sole owner of these goods. DoveBid acts as an agent for on behalf of the seller and does not have any right title or interest in the ownership of these goods and does not accept any liability to any third party with regard to these goods.
   
5. A “tender sale” is a private treaty sale in which the seller reserves the right to refuse an offer at any time without any justification or explanation .The seller reserves the right to merge or split some lots and to withdraw items from the sale.
   
6. The seller reserves the right to withhold delivery of items to any successful bidder until full payment is received. Removal or dismantling of sold items must be made before May 13th 2006, after receipt of final payment. Collection of the items will be subject to prior agreement with DoveBid.
   
7. Buyers will take full responsibility for the items as soon as final payment is received by DoveBid. 8. Foreign buyers from countries not belonging to the European Union will be refunded of the VAT after receipt of the original export documents properly stamped to prove that the export has been carried out. Foreign buyers from countries belonging to the European Union should provide DoveBid with proof of their VAT Registration Number in order that VAT will not be charged.
   
9. Should the buyer fail to provide full payment within 5 opening days or cancel his bid, his bid will be considered void with no recourse, but the seller will not be entitled to ask any penalty fee to the buyer.
   
10. Should the buyer fail to meet payment terms or cancel his bid, DoveBid will be entitled to a penalty fee amounting to 13.5% of the bid amount from the buyer.
    
11. If it appears that an item cannot be delivered, totally or partially, by the seller, for any reason whatsoever, DoveBid will be authorized to declare the sale void, after which DoveBid and/or the seller will reimburse payments to the buyer but will not be liable to pay any damage to the buyer.
    
12. The items are sold “as is, where is”, with no guarantee as regards condition including any hidden flaw. In any event, the buyer will be deemed to have carefully inspected the items he purchases beforehand. The buyer will be deemed competent and to have been informed, before the closing date for biddings, of any error in the descriptions as well as any flaw or imperfection of the items.
    
13. The seller’s shall not be liable for any damage to the buyer’s professional property, resulting from any flaw in the items.
    
14. According the article 18 of the French law 2005ferred to the buyer.
    
15. Dismantling and collection of the items sold will be entirely at the buyer’s cost and under his responsibility. Neither the seller nor DoveBid shall be liable to the buyer or any third party for additional costs due to any work necessary work to collect the items out of the seller’s premises. The buyer’ shall be liable for any accident, damage to persons, to buildings or to third party’s belongings during the dismantling and collection. No responsibility whatsoever can be accepted with regards to quantity, quality, dimensions, year of manufacture and completeness of the items as shown in the catalogue.
    
16. The seller is solely responsible for the correctness and clarity of the details and descriptions included in the catalogue.
    
17. Pictures of the items as shown in the sales catalogue or sales lists are provided for the sole purpose of better differentiation and under no circumstances do they represent properties or characteristics of the items for sale.
    
18. The buyer declares to be duly entitled to sign and purchase the items on behalf of his company and agrees with the above-mentioned general sale conditions of the sale by tender. 19. In the event of any dispute only the French version of these sales terms conditions of sale shall be decisive.
    
19. Place of performance and court jurisdiction is Nanterre (France), insofar as an agreement on the court of jurisdiction is permissible.
